{"id":24447,"date":"2021-10-29T12:21:08","date_gmt":"2021-10-29T15:21:08","guid":{"rendered":"https:\/\/thelaker.ca\/?p=24447"},"modified":"2021-10-29T12:21:08","modified_gmt":"2021-10-29T15:21:08","slug":"n-s-introduces-amendment-to-cannabis-legislation-protecting-them-from-unreasonable-searches","status":"publish","type":"post","link":"https:\/\/staging-z.thelaker.ca\/?p=24447","title":{"rendered":"N.S. introduces amendment to cannabis legislation  protecting them from unreasonable searches"},"content":{"rendered":"\n<p>[adrotate banner=&#8221;105&#8243;]<\/p>\n\n\n\n<p>[adrotate banner=&#8221;95&#8243;]<\/p>\n\n\n\n<p><strong>HALIFAX:<\/strong> The provincial government introduced an amendment Oct. 28 to the Cannabis Control Act to clarify the standard of reasonableness required to search a place or vehicle.<br \/><br \/>In a recent provincial court case, the section of the act that deals with search and seizure was found to lack clarity and ruled statutorily invalid.<br \/><br \/>&#8220;Public health and safety are the primary goals of our cannabis legislation, but it is equally important that the charter rights of Nova Scotians are protected from unreasonable searches,&#8221; said Brad Johns, Minister of Justice and Attorney General. &#8220;We believe this amendment strikes that balance.&#8221;<\/p>\n\n\n\n<p>[adrotate banner=&#8221;31&#8243;]<\/p>\n\n\n\n<p>[adrotate banner=&#8221;34&#8243;]<br \/><br \/>The amendment to section 24(1)(a) of the Cannabis Control Act requires the standard of &#8220;reasonableness&#8221; to ensure compliance with the charter and clarity to law enforcement officers.<br \/><br \/>Police investigating violations under the act will need to have &#8220;reasonable grounds to believe&#8221; before conducting a search for illegal cannabis.
